Private Plan Disability Benefits - General Information

The Temporary Disability Benefits Law permits employers to provide coverage for temporary disability benefits through an approved Private Plan instead of the State Plan. The Plan may be insured by the employer, by an insurance company or a union welfare fund. Private Plans vary from employer to employer. Workers covered by a Private Plan should familiarize themselves with its provisions. All Private Plans must be approved by the Division of Temporary Disability Insurance, Private Plan Operations.

Private Plans must be at least as liberal in benefit amounts, eligibility requirements and duration of payments as the State Plan. Some are more liberal.

The State Plan and Private Plans must provide coverage for those employees who become disabled while employed or within two weeks of their last day in covered employment. However, if your disability begins more than 14 days after your last day in New Jersey covered employment, a claim for Disability During Unemployment should be filed.

Private Plan Claims

If you are covered under a private plan, your employer's private plan carrier is responsible for processing and paying benefits on your disability claim. You can obtain a claim form from your employer. Complete the form and submit it to the carrier for processing. If you submit your claim to the State for processing, we will forward it to the insurance carrier. This will delay your claim and delay your benefits.
