Crane Operators Laws and Regulations Overview

The Licensing of Crane Operators Act (N.J.S.A. 45:26-1 et. seq.) and Regulations (N.J.A.C. 12:121) mandate that persons eligible for licensing as defined in the Act (see Chapter 171, 45:26-8) as an operator of a crane receive and maintain a certification from the National Commission for the Certification of Crane Operators, or an approved, equivalent certification program.

The Act identifies, establishes fees and grants licenses for crane operators. Described in the regulation and code is the establishment and make-up of the membership for a Crane Operators License Advisory Board. Additionally, the Act specifies criteria for licensure as well as provisions for renewal, revocation and suspension of crane operator licenses. The Act empowers the commissioner to enforce the named provisions, authorize penalties and prosecute for violations.

The Act regulates the operation of certain power-operated hoisting machines used in construction, demolition, or excavation work. It does not apply to the licensing or regulation of cranes with the United States military forces or US allies. The Act does not apply to New Jersey State Police and Fire Departments carrying out official and public duties. Additionally, the Act exempts any person operating a crane while under direct supervision of a certified trainer of crane operators, and while operating such crane on the grounds of a training facility.

Persons operating forklifts, digger derrick trucks, aircraft, bucket trucks, knuckle booms, trolley booms, or any vehicles or machines not having a power-operated winch and load line are not subject to the provisions of this Act.
