Family Leave Private Plan - Appeals

If you disagree with the determination of your family leave claim made by the private plan carrier, you have the right to appeal to the Division of Temporary Disability Insurance. You have one (1) year from the start of your period of family leave to file your appeal.

Your appeal must be in writing and can be mailed or faxed.

Once the appeal is filed, you will be notified by mail of the date, time and location of the appeals hearing. Hearings may be held at various locations throughout the State. Hearings may also be held by telephone. There is no cost for you to appear before the Private Plan Hearing Officer. It is not necessary to have an attorney represent you, however you may have one if you choose.

Following the hearing, the Private Plan Hearing Officer will issue a written order which is binding. However, if you disagree with that decision, you have the right to file an appeal with the Appellate Division of the New Jersey Superior Court. The appeal must be filed within forty-five (45) days of the date of mailing on the Private Plan Hearing Officer's order. Instructions for the appeal to the Appellate Division will be included on the Hearing Officer's decision.
