Family Leave Private Plan - General Information

The Temporary Disability Benefits Law permits employers to provide coverage for Family Leave Insurance benefits through an approved Private Plan instead of the State Plan. The Plan may be insured by the employer, an insurance company or a union welfare fund. All Family Leave Private Plans must be approved by the Division of Temporary Disability Insurance.

The provisions of a Private Plan may vary from employer to employer and may be more liberal than the State Plan, however:

  • Benefits must be equal to or better than benefits provided under the State Plan,
  • Eligibility requirements can not be more restrictive than the State Plan, and
  • The cost to workers cannot be more than the cost to workers under the State Plan.
