Layoffs & Closings

Summary of Federal WARN Act and New Jersey Business Closing/Mass Layoff Notification Law (a.k.a. NJ WARN)

STEP 1: Federal WARN

If you are an employer with 100 or more employees, you may be required to comply with the WARN notification laws.


STEP 2: NJ WARN

A. Provide notification of the termination or transfer of operations or mass layoff to the chief elected official of the municipality where the establishment is located, each employee whose employment is to be terminated and any collective bargaining units of the employees at the establishment USING THIS HARD COPY FORM

B. Provide notification of the termination or transfer of operations or mass layoff to the Commissioner of Labor and Workforce Development USING THIS ON-LINE FORM

Note: Providing notification to the Commissioner of Labor and Workforce Development using the on-line form will only satisfy the requirement under B. above.  In order to provide notification to the chief elected official of the municipality where the establishment is located, each employee whose employment is to be terminated and any collective bargaining units of the employees at the establishment, you must use the hard copy form under A. above.


STEP 3: RAPID REEMPLOYMENT INITIATIVE (RRI)

Help your displaced employees.  Register with RRI to enter your downsizing activities and information for hiring employers. 





STEP 4: RAPID RESPONSE
 

The New Jersey Department of Labor and Workforce Development Response Team assists both employers and workers involved in a closing or permanent mass layoff.  The Response Team provides on-site assistance during your working hours and at no cost to you.

Unemployment Insurance:
  • Explanation of benefits and eligibility requirements
  • Assistance in filing claims

Reemployment Services:
  • Referrals to available jobs
  • One-Stop Career Center Registration
  • Labor Market Information
  • Referral to Jersey Job Club 
  • Resume Development

Training Assistance:
An introduction to state and federal retraining programs including assistance available through New Jersey Community Colleges.

Additional Customized Services can be provided in the following areas:
  • Job Search Workshops
  • Resume Workshops
  • Help with job solicitation campaigns
  • Targeted Job Fair assistance
  • Registration Forms Completion
  • Help in deciphering federal/state plant closing requirements

Initial Meeting:
Response Team Specialists will meet with your management and union personnel (if appropriate) to develop a plan to serve your company’s workforce. This meeting identifies the services to be offered and the service delivery dates. Confidentiality, if requested, is assured.
 
Meeting with Workers:
Group meetings with your workforce are held according to your schedule. Program information is provided, including information on how to file for Unemployment Insurance Benefits.
